Node Fortress Wallet – Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Node Fortress Wallet (the "Wallet"), a self-custodial Canton Coin (CC) and CIP-56 token wallet provided via a MetaMask Snap integration. By installing, accessing, or using the Wallet, you agree to be bound by these Terms. If you do not agree, do not use the Wallet.
1. Agreement to Terms
1.1 Acceptance. By accessing or using the Wallet, you accept and agree to be bound by these Terms and any additional terms that may apply to specific features of the Wallet. These Terms constitute a legally binding agreement between you and Node Fortress LLC ("Node Fortress," "we," "us," or "our").
1.2 Consent to Policies. Your use of the Wallet is also governed by our Privacy Policy, which explains how we collect, use, share, and protect information, and by any other policies or guidelines referenced in these Terms.
1.3 Eligibility. You represent and warrant that you are at least the age of majority in your jurisdiction and have full legal capacity to enter into and comply with these Terms. You may not use the Wallet if doing so would be illegal in your jurisdiction.
2. Overview of the Wallet
2.1 Self-Custodial Nature. The Wallet is a self-custodial interface that allows you to manage Canton Coin and CIP-56 tokens on supported networks. You (and not Node Fortress) retain exclusive control over your private keys and digital assets.
2.2 No Custodial Relationship. Node Fortress does not hold, control, or have access to your private keys, secret recovery phrase, digital assets, or transaction history.
3. Your Responsibilities and Risk Acknowledgment
3.1 Security and Backup. You alone are responsible for securing and backing up your private keys, recovery phrase, accounts, and devices. Node Fortress will never ask for your secret recovery phrase or private keys and cannot recover assets if such data is lost.
3.2 No Liability for Loss. You acknowledge the Wallet and associated blockchain transactions entail risks, including but not limited to loss of assets due to user error, malware, phishing, compromised devices, irreversible transactions, bugs in the Wallet or network infrastructure, and network failures.
3.3 No Professional Advice. The Wallet does not provide financial, legal, tax, or investment advice. Any content accessible via the Wallet is for informational purposes only.
4. Third-Party Integrations
4.1 Use of MetaMask & Snaps. The Wallet is provided through a MetaMask Snap and thus depends on third-party platforms such as MetaMask, Consensys infrastructure, and browser or mobile environments. We do not control these third parties and are not responsible for errors, downtimes, security vulnerabilities, or changes in their services.
4.2 Third-Party Terms. Your use of any third-party products, services, or content via the Wallet is subject to the terms, privacy policies, and fees of those third parties.
5. License
5.1 Limited License. Subject to these Terms, Node Fortress grants you a limited, revocable, non-exclusive, non-transferable license to use the Wallet solely in accordance with these Terms.
5.2 Restrictions. You may not copy, distribute, modify, reverse-engineer, decompile, or create derivative works of the Wallet except as expressly permitted by open-source licenses or law.
6. Changes to the Wallet or Terms
6.1 Service Changes. Node Fortress may modify, update, suspend, or discontinue any aspect of the Wallet at any time and without notice.
6.2 Updates to Terms. We may change these Terms at any time. We will use commercially reasonable efforts to notify you of material changes. Continued use of the Wallet after changes constitutes acceptance of the revised Terms.
7. Privacy and Data
7.1 Data Handling. Because the Wallet is self-custodial, it does not collect personal information to operate the core wallet functionality beyond what's necessary for the Snap's operation. Your use of any third-party service may involve separate data practices outside Node Fortress's control.
8. Disclaimers
8.1 As-Is. THE WALLET IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Node Fortress DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.2 No Guarantee. We do not guarantee the availability, performance, or security of the Wallet or underpinning blockchain networks.
9. Limitation of Liability
To the fullest extent permitted by law, Node Fortress and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Wallet, including loss of digital assets, even if advised of the possibility of such damages.
10. Indemnification
You agree to indemnify, defend, and hold harmless Node Fortress, its officers, affiliates, and partners from any claims, losses, liabilities, damages, and expenses arising out of your breach of these Terms or your use of the Wallet.
11. Termination
Node Fortress may terminate or suspend your access to the Wallet at any time for any reason, including for violation of these Terms or if required by law. You may discontinue use at any time by removing the Snap.
12. Governing Law
These Terms shall be governed by and enforced in accordance with the laws of the State of New Jersey, United States, without regard to conflict of law principles.
